A major showdown is brewing over the future of prediction markets, and the head of a key federal agency is stepping into the ring! The Commodity Futures Trading Commission (CFTC) is making a bold move to put a stop to what they describe as a "barrage" of state-level regulations targeting these increasingly popular platforms.
CFTC Chairman Michael Selig announced on Tuesday that the agency has officially filed a "friend of the court brief" to back Crypto.com in their ongoing legal dispute with Nevada regulators. This is a landmark moment, as it's the first time under Chairman Selig's leadership that the CFTC has publicly sided with prediction markets in their escalating battle with state authorities.
But here's where it gets controversial... The CFTC's intervention essentially argues that these prediction markets fall under federal regulation, rather than being subject to state gambling laws. "Over the past year, American prediction markets have been hit with an onslaught of state-led litigation," Selig stated in a video. He further emphasized, "The CFTC will no longer sit idly by while overzealous state governments undermine the agency’s exclusive jurisdiction over these markets by seeking to establish statewide prohibitions on these exciting products."
This debate is exploding in popularity alongside the platforms themselves. For instance, Kalshi reported a staggering $1 billion in total trading volume for Super Bowl LX, a massive 2,700% jump from the previous year!
And this is the part most people miss... While states like Massachusetts and Nevada have been attempting to restrict these markets, issuing cease-and-desist letters and labeling them as unlicensed gambling, the CFTC sees them differently. Industry advocates argue that these are not traditional games of chance but rather financial exchanges. In these markets, users trade contracts with each other, and the platforms don't act as a 'house' or set odds. Instead, they function much like brokerages, earning transaction fees.
Chairman Selig highlighted the practical uses of prediction markets, suggesting they allow Americans to "hedge commercial risks like increases in temperature and energy price spikes" and serve as "an important check on our news media and our information screens."
However, not everyone agrees. Utah's Republican Governor Spencer Cox took to X to declare he would use "every resource within my disposal" to "beat" Selig in court, calling these markets "gambling—pure and simple" and asserting they are "destroying the lives of families and countless Americans, especially young men."
In contrast, Senator Bernie Moreno of Ohio voiced his support for Selig's stance, emphasizing that "Clear lines of delineation and clarity on regulations is essential for American led innovation."
This development also follows a letter from a group of Democratic senators, led by Nevada's Catherine Cortez Masto, urging the CFTC to "abstain from intervening in pending litigation involving contracts tied to sports, war, or other prohibited events."
As states try to get a handle on these rapidly growing platforms, the core question isn't just whether they constitute gambling, but who ultimately gets to make that decision.
Selig concluded with a stern warning to state attorneys general: "To those who seek to challenge our authority in this space, let me be clear: We will see you in court."
